Challenge:  Deliver basic legal literacy information to a variety of audiences in easily accessible written and oral formats.

 

Solution:  Promote fairness in the debt collection process by informing unrepresented consumers about court procedures and their rights and responsibilities.  Expedite court proceedings by narrowing the issues for consumer debtors before they appear in court.

 

•Offer practical suggestions for communicating with creditors and deciphering jargon in legal papers and in the courthouse.

•Explain time limits for taking action in a lawsuit, the consequences when a time limit has been missed, and possible courses of action for remedying missteps in the legal process.

•Describe the types of help the courts can offer debtors during the litigation, including relief from wrongful lawsuits, abusive discovery, and unreasonable settlement demands.

•Explain how to ask for help from the court and what to expect after a request has been made.

 

Results:  Unrepresented consumers are better prepared to engage in the debt collection and litigation process, preserving their rights and thereby reducing confusion and court delays.

Challenge:  Provide support to the judiciary in two of New York State’s busiest trial courts.

 

Responsibilities:  Authored judges’ decisions in pending cases, consistent with direction and input from the presiding justice in each case, for the particular judge’s signature.  Presided over discovery disputes in complex cases.

 

Results:

•Expedited the resolution of complex litigation.

•Narrowed the issues to be litigated.

•Saved the courts and litigants time and money.

•Applied the rule of law to disputes in a wide range of industries, involving outcomes ranging from the personal, and routine, to those

having high dollar values, or wider social impact.

•Wrote precedent-setting case law.

•Defined the parties’ discovery rights and obligations.

•Eliminated the opportunity for delay and abuse of the discovery process.

•Set time frames for performance.

•Identified key witnesses and documents.

•Directed the parties to exchange information under court order.

Volunteer in Bronx County Supreme Court at Fordham Law School’s Consumer Law Clinic. One-on-one counseling with consumers who are defendants in pending consumer debt litigation.  Advise and inform on court practice and procedure, and the rights and responsibilities of debtors/litigants.
